1. Overview
This website is owned by Street Provisions, LLC. and operated by PastDriven LLC. (“Company,” “we,” “our,” or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of our website and services, including private dining services, catering services, digital products, physical products, cookbooks, recipes, and related offerings (collectively, the “Services”).
By accessing our website or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use our website or Services.

2. Eligibility
To use our website or Services, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction

  • Have the legal authority to enter into binding agreements

  • Not be prohibited from using our Services under applicable law


3. Services & Booking Policy (Private Dining & Catering)
 
3.1 Quotes & Expiration
All event quotes include an expiration date. Pricing and availability are not guaranteed until a quote is accepted and the required deposit is received.
 
3.2 Deposit & Payment Structure

  • A 50% non-refundable deposit is required to secure an event date.

  • Dates are reserved on a first-come, first-served basis.

  • The remaining balance is due no later than seven (7) days prior to the event date, unless otherwise stated in writing.

  • Payment plans may be granted and are not exempt from the 50% non-refundable deposit.​​

  • Failure to submit payment by the due date may result in cancellation of services.
     

3.3 Final Guest Count
Final guest count must be submitted no later than seven (7) days prior to the event date.
Final pricing is based on the confirmed guest count and agreed scope of services.
 
3.4 Scope Changes
Any additions or modifications to the agreed services may require a revised proposal and pricing adjustment.
 
3.5 Rescheduling & Cancellations
Rescheduling requests must be submitted in writing. Approval is subject to availability.
All deposits are non-refundable unless otherwise stated in writing.

4. Event Conditions & Client Responsibilities
The Client agrees to:

  • Provide accurate service requests, event details, including venue access, timing, and guest count

  • Ensure safe and reasonable working conditions for staff

  • Obtain any required venue permissions or approvals

  • Inform guests of relevant event policies

We reserve the right to withdraw services if working conditions are unsafe, illegal, or materially different from those agreed upon.

5. Products (Physical & Digital)
 
5.1 Pricing
Prices for products and services are listed on the website or provided via custom quote. We reserve the right to modify pricing at any time and correct errors.
Applicable taxes and transaction fees may apply.
 
5.2 Returns (Physical Products Only)
Undamaged physical products may be returned within 14 days of receipt, provided they:

  • Are unused

  • Include proof of purchase

Digital products and perishable items are non-refundable.
Returns must be made in the country of original purchase.

6. Payment Terms
By submitting payment, you authorize us to charge your selected payment method for:

  • Event deposits

  • Remaining balances

  • Product purchases

  • Applicable taxes and processing fees

Failure to remit payment when due may result in suspension or termination of Services.

7. Intellectual Property
All content on this website — including but not limited to text, images, branding, menus, recipes, graphics, logos, videos, software, and design elements — is the exclusive property of Street Provisions, LLC. and PastDriven LLC., unless otherwise noted.
You may not:

  • Copy

  • Reproduce

  • Modify

  • Distribute

  • Sell

  • Republish

  • Create derivative works

Without prior written permission.

8. User-Submitted Content
If you upload or submit content to us (including images, testimonials, or media), you confirm that:

  • You own the rights to the content or have permission to share it

  • You grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for business and marketing purposes


9. Media Release & Event Photography
By engaging our Services, you acknowledge and agree that photographs and/or videos may be taken during events.
These may include:

  • Event setup

  • Food presentation

  • Staff

  • Venue

  • Guests (where visible in event coverage)

You grant Street Provisions, LLC. and PastDriven LLC. permission to use such media for marketing, promotional, advertising, website, social media, and print purposes.
As the event host, you are responsible for informing your guests of this policy.
If any individual does not wish to appear in media, written notice must be provided to us prior to the event.
All captured media remains the property of Street Provisions, LLC. and PastDriven LLC. No compensation will be provided for such use.

10. Assumption of Risk & Food Service Disclaimer
The Client acknowledges that food service involves inherent risks, including but not limited to allergic reactions and dietary sensitivities.
Clients are responsible for:

  • Communicating food allergies or dietary restrictions in advance

  • Informing guests of potential allergens

While we take reasonable precautions, we cannot guarantee an allergen-free environment.

11. Limitation of Liability
To the maximum extent permitted by law:
Street Provisions, LLC. and PastDriven LLC. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of our website or Services.
Our total liability, if any, shall not exceed the amount paid to us for the specific service giving rise to the claim.

12. Indemnification
You agree to indemnify and hold harmless Street Provisions, LLC. and PastDriven LLC. from any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising out of:

  • Your use of our website

  • Your event

  • Your violation of these Terms

  • Any third-party claims related to your event or conduct


13. Service Modifications & Termination
We reserve the right to:

  • Modify or discontinue any Service

  • Limit access to the website

  • Suspend or terminate accounts

At our sole discretion, with or without notice.

14. Warranties (Physical Products Only)
If a valid defect claim is received for a physical product, we will:

  • Repair the product

  • Replace the product

  • Or issue a refund if repair/replacement is not possible

Return shipping of defective items to us is the responsibility of the customer unless otherwise required by law.

15. Promotional Communications
By providing your contact information, you consent to receive marketing communications from us via email, phone, or text.
You may opt out at any time by contacting us or using the unsubscribe feature.

16. Privacy
Your use of our website and Services is also governed by our Privacy Policy.

17. Changes to Terms
We reserve the right to modify these Terms at any time.
Continued use of our website or Services after changes constitutes acceptance of the updated Terms.

18. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of:
The United States of America and the State of South Carolina
Any disputes shall be resolved exclusively in a court of competent jurisdiction located in Columbia, South Carolina.
The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
